Welcome to Midstream. These Terms of Service ("Terms") govern your access to and use of the Midstream platform, website, and services (collectively, the "Service") operated by Midstream ("we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Definitions
- "Account" means your registered account on the Service.
- "Content" means any code, data, text, screenshots, demos, or other materials uploaded to or generated through the Service.
- "Customer Application" means a web application owned or controlled by you that is connected to the Service for the purpose of generating demos.
- "Demo" means an interactive, shareable preview of a Customer Application state generated through the Service.
- "Checkpoint" means a specific point in a Playwright test captured by the Midstream SDK for demo generation.
- "User" or "you" means any individual or entity that accesses or uses the Service.
2. Account Registration
To use certain features of the Service, you must create an Account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your Account credentials.
- Promptly notify us of any unauthorized use of your Account.
- Accept responsibility for all activity that occurs under your Account.
We reserve the right to suspend or terminate Accounts that violate these Terms.
3. Description of Service
Midstream is a developer tool that turns Playwright end-to-end tests into shareable, live demos. The Service provides:
- An SDK for integration with Playwright tests.
- Infrastructure for generating and hosting interactive demos.
- A dashboard for managing demos, repositories, and team collaboration.
- API access for programmatic integration.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights.
- Upload or transmit malicious code, viruses, or harmful content.
- Attempt to gain unauthorized access to the Service or its infrastructure.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to generate demos of applications you do not have the right to access or demonstrate.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Resell, sublicense, or redistribute the Service without our prior written consent.
- Use the Service in a manner that could damage, disable, or impair the Service.
5. Intellectual Property
Your Content
You retain all rights to your Content. By using the Service, you grant us a limited, non-exclusive license to access, process, and display your Content solely as necessary to provide the Service.
Our Service
The Service, including its design, features, and underlying technology, is owned by Midstream and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
Feedback
If you provide feedback or suggestions about the Service, we may use them without obligation or compensation to you.
6. Payment and Billing
- Certain features of the Service may require a paid subscription.
- Fees are charged in advance on a monthly or annual basis, depending on the plan selected.
- All fees are non-refundable except as required by law or as explicitly stated in a separate agreement.
- We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance.
- If payment fails, we may suspend access to paid features until the balance is resolved.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge that:
- We may collect and process data as described in our Privacy Policy.
- Demos generated through the Service may be accessible to anyone with the demo link unless access controls are configured.
- You are responsible for ensuring that your Customer Applications do not expose sensitive data through demos.
8. Availability and Support
- We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
- We may perform scheduled maintenance with reasonable advance notice.
- Support is provided according to the terms of your subscription plan.
9. Termination
By You
You may terminate your Account at any time through the dashboard or by contacting us. Termination does not entitle you to a refund of prepaid fees.
By Us
We may suspend or terminate your access to the Service at any time if:
- You violate these Terms.
- Your use poses a security risk to the Service or other users.
- We are required to do so by law.
- Your Account has been inactive for an extended period.
Effect of Termination
Upon termination:
- Your right to access the Service ceases immediately.
- We may delete your Content after a reasonable retention period.
- Provisions that by their nature should survive termination will remain in effect.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
- DEMOS WILL ACCURATELY REPRODUCE ALL ASPECTS OF YOUR CUSTOMER APPLICATION.
- THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIDSTREAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Midstream, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third-party rights.
- Content you upload or generate through the Service.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.
15. General Provisions
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Midstream regarding the Service.
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
